Subject: IMPORTANT EMPLOYEE RIGHTS INFORMATION

 

The following order and ground rules replace any previous memoranda and emails issued by NMSU concerning the AFSCME employee union organizing campaign; specifically, a September 15, 2004, email from Cher Quijano (NMSU Human Resources), and a memorandum sent on August 11, 2005, from Ben Woods.

 

BY ORDER OF THE NMSU LABOR MANAGEMENT RELATIONS BOARD*:

 

Effective October 25, 2005, the following ground rules replace any previous memoranda and emails issued by NMSU concerning this employee union organizing campaign.  These ground rules apply to all NMSU employees, including supervisors and managers in every NMSU department, location and work site.

 

These ground rules are intended to ensure that employees are guaranteed "the right to organize and bargain collectively with their employer, to protect the rights of the employer and the employees and to promote harmonious and cooperative relationships between the employer and the employees; and to acknowledge the obligation of the employer and the employees to provide orderly and uninterrupted services to the citizens."  (New Mexico State University Labor Management Relations Resolution, Section 2)

 

The NMSU Labor Management Relations Board trusts employees to make reasonable common sense decisions as they relate to union organizing activity and not having it interfere with their work duties as they would any other non-work activity.

 

1. Employees are free to conduct union activities or attend union meetings on non-work time, which is the time before their work day begins, during lunch and breaks taken during the work day in accordance with their established departmental policy or practice, or after their work day ends.

 

2. Employees may discuss union activities in work areas during work time so long as such activity does not disrupt their work or others who are working.  Employees' free speech rights are respected in accordance with NMSU Freedom of Expression Policy 3.63.

 

3. Employees may distribute union literature during non-work time in non-work areas.  Non-work areas are any areas publicly accessible where work is not being performed, including outside areas, not restricted for the purpose of safety and security.

 

4. Employees engaged in union activity will not be treated differently than employees engaged in other permissible activities.

 

5. NMSU will not restrict or discourage employees from supporting the union or engaging in union activities in accordance with these ground rules.

 

6. Employees will have reasonable access to available space for the posting of union materials on department bulletin boards.

 

7. Employees may use university phones, email, faxes and other resources for union activity consistent with NMSU Personal Use of University Resources Policy 3.75.

 

8. Employees may use rooms to hold union meetings by reserving the

room(s) in accordance with the policy, practice or approval procedure established for that room.

 

Violation of these ground rules may result in disciplinary action.

 

The NMSU administration and the AFSCME NMSU Organizing Committee have designated these representatives to provide information, resolve

complaints and/or answer any questions related to these ground rules.
